In HBP, Harry and Hermione are under the cloak at Godric's Hollow, when
Nagini (inside Bathilda Bagshot who is presumably some weird inferius
betwitched to house the horcrux snake) follows them to the gate and beckons
to them, or at least to Harry.

So how can she see under the cloak - or is this some special snake or
horcrux power?

Just a wild guess: extremely powerful magical beings have the ability
to detect magic where regular wizards can't. Dumbledore sets an
example of this in HBP when he and Harry are in the cave and he
figures out both how to get past the wall and where to find the
transportation designed to take you to the center where the horcrux
supposedly is. Way before that, Dumbledore could see them in CoS when
they are hiding in the corner of Hagrid's hut; Moody does so in OotP
in the bar when he and Hagrid come to the table Hermoine (and a
cloaked Harry) is sitting and also GoF, although Moody was really BCJr
when he spotted Harry with his leg stuck in the trick step, which can
only mean the magic eye of Moody's was the source of the higher
magical power, instead of Moody being exceptionally powerful himself.
I would even venture a guess Voldemort could see through the cloak if
he actually were given the opportunity. Also, unless I am mistaken,
Mrs Norris can see into the cloak as well in CoS. I could be wrong on
that last one, though.

Was he under a cloak? I thought he was out in the open. A DE would
be less likely to attempt the theft with a guard present than if it
was unguarded.

That's what I think too. In OotP, we have described for us the
sensations of Nagini/Voldemort/Harry as they attack Arthur at the MoM

No, I think Harry recognized it by then, and would have realized
something was up. Plus, she tended to gesture a lot.
